>> reporter: i'm hearing four people were taken to the hospital, that includes a mother and two of her young children. 13 cars were involved in all, and that includes the truck. this all happened about 4:30 this afternoon. a dump truck, and i'm sure you can see it from the aerials right now, getting off that freeway looks like it had some mechanical trouble and slammed into about a dozen cars. with me is katy evans. she was on the off-ramp when it happened. katy, what did you hear and see? >> i was parked at a red light and all of a sudden i heard a couple of bangs and thought it was gunshots. then i looked in my rear view mirror and it was hitting the rear of one carafe another. i tried to avoid it but i got a little hit on the side. >> you're okay. we see a car that looks like an accord on. what happened to the person inside that car? >> a couple of people got in an

ambulance to get taken to the hospital because i think they had whiplash and injuries like that. >> reporter: and you do search and rescue and you do some type of work where you can help people, right? >> yes. i'm wilderness first aid trained so i spent my summers helping people like that. so i hopped out of my car, called 911 and made sure everyone was okay. >> reporter: okay, katy. thank you from lafayette. i'm glad you're oklahoma. i had a chance before we went on the air to talk to the truck driver. he did not want to go on camera but he believes that his brakes went out. he tried to stop the truck as best as he could. as soon as he was able to get out of the truck, he started to check on victims. he saw them on the side of the road. he seems really shaken up. he didn't want to give his name but he said he didn't want to give his name because he's been driving trucks for a long time and he can't believe that this has happened to him.

tom? >> cheryl, let me ask you something. what was he hauling in the back of the truck? >> reporter: he's based out of san francisco. it looked empty, and that's a good thing. i didn't ask what he was hauling. they're still trying to gather information and see who -- what person goes with what car. i heard this before, and it's really true. it looks like a demolition derby out here. but the good thing is it looks like everybody will be okay. >> well, okay. cheryl hurd in oakland. thank you very much. and obviously we're going to say the truck was either very heavy or going pretty quickly when it lost its brakes. look at the damage in front of it. that was incredible. again, no life-threatening injuries tonight. we'll keep you up to date. and now to a developing story. he is the mystery man in an east

bay killing spree. he was found inside his house with two dead bodies and a lot of explosives, and yet tonight he's a free man. nbc bay area's jodi hernandez is live. how is it possible? what explanation does he have for the bodyies. >> reporter: as you said he could be walking out any moment. when he does, he'll be walking out beside me, that's the side door to the jail. a short time ago a bail bondsman arrived to post the $25,000 bond, even though one of the lead investigators this this case wrote in this declaration that he believes writtenhouse is a threat to the society, he'll be a free man. >> reporter: 72-year-old charles rittenhouse will soon be heading home. the judge lowered his bay to $25,000 after the prosecutors

said they don't have evidence to charge him with the deaths of his wife and a friend. >> the family has been through a lot. his wife was murdered. he's been in custody over a week. that's good news. >> there's a lot more investigation to be done. >> reporter: investigators say he's not off the hook yet. he has been charged with possessing explosives materials and he's still considered a person of interest in the killings. according to court documents obtained by nbc bay area, investigators found one of the women's bodies in a bag in a rear closet, the other under some bushes in the backyard. police don't know who killed the women. >> i would hope we would find definitive evidence so someone would be responsible and be found to be responsible. >> reporter: prosecutors say another also remains a person of interest. they shot and killed him following a high-speed chase last week and after they say he

killed two other people. >> it certainly seems like he was involved. he had been stalking my client and his wife. >> reporter: he said he's devastated by his wife's murder and once released will plan her memorial. again, we're live at the door where he could walk out of at any moment. we're also learning more tonight about some of the explosives materials that investigate ors y they found at rittenhouse's home. according to this declaration i'm holding in my hand, investigators found tnt flakes, c 4, high explosives, rocket igniters, and safety fuses. despite all that he will be released on bail in a few short minutes at least for the time being. reporting live in fairfield, i'm jodi hernandez, nbc bay area

news. an east bay park was the site of a pot bust today. they surrounded a camp at a wilderness park west of danville. the illegal crop of nearly 2,000 plants was found in a remote part of the park about 30 minutes hike from the nearest trail. they spotted the plants by helicopter three weeks ago. they moved in today. they arrested one man. a second escaped. >> worst-case scenario, this could be a mexican drug cartel operation. it's hard to say at this point. we'll have to see what information we can get from the suspect, but apparently he does not speak any english, so we have a spanish-speaking officer with him at this point. >> the camp is described as fairly sophisticated with tents, food, and a pump which drew water from a spring located nearby. a senior aid to california senator barbara boxer is facing drug charges tonight.

make that former aide. he was arrested in washington yesterday. police say he tried to hide a bag of marijuana after a security screening. he has been senior economic adviser to boxer since 2009 and worked on the senate environment and public works committee. he resigned immediately. senator boxer's office says she accepted his resignation because, quote, his actions were wrong and unacceptable. well, tonight that long debated b.a.r.t. airport and connector appears to be on track. private funding won approval despite a great deal of opposition. this has been a long, long running feud over this. >> reporter: oh, gosh, jessica, you're absolutely right some people can't even agree on how long it's been. some people say it goes back to 1984. now, today there was a war of words during the pub hick comment portion of this meeting, but the metropolitan transportation commission votes

don't really reflect that. now, two of the eight members voted against it, and bart's director says the connector is not far from finally getting approved and ending up here at the oakland airport. applause when they approved the make or break state funding for the oakland airport connector was a little weak, almost as if the supporters of the project were waiting for the cash. more than two decades of the planning and a victim of countless delays, the project is designed to take passengers to a people mover and then on to oakland airport rather than have them hop on a train, into a bus and into the terminals. waiting for the air b.a.r.t. bus to arrive and then making it to the airport is making it harder to make it to her flight on time. >> the longer we delay and the longer we keep going and the

longer we don't build it the higher the cost goes. >> reporter: it's now $484 million, nearly four times the original projection, a point not lost on its opposition in today's meeting? all things considered, despite the monies already spent, despite, you know, the pending contract, that it makes sense to change course right now. >> is the legacy you want to see one of hemorrhaging of riders. >> reporter: those who fought say it will create hundreds of jobs and given them the world-class transportation system it deserves. >> i'm really sick of this feeling that if it's good for san francisco we do it. but if it's going in oakland, we're going to crap on oakland. i'm really as a commissioner getting tired of seeing oakland being crapped on. >> we have one or two more steps to go through and then we'll have a home run.

one or two steps is okay with me because we've had about 30 steps. >> reporter: okay, next stop, california transportation commission. the ctc has to sign off on the $20 million in funding before the connector can finally be billed. b.a.r.t.'s director says that shouldn't be a problem considering that the ctc voted unanimously in favor of this project once before. live in san francisco, traci grant. police say they will allow high bridge arms to resume business as soon as it meets a few requirements including getting an alarm system and security cameras. the store on mission street has been doing business for five decades. some neighborhood activists argue that it brings crime to the area and doesn't belong on a residential street in the first place. the store's manager takes issue with that. >> for one, i think san francisco has stood on our necks back then, but going on almost

60 years now, we haven't really been a problem for this community, but although e-mails are saying otherwise. >> well, the store ran into some trouble when the owner decided he was going to convert it to office space and let his permit expire. when he desired to reapply, three community groups asked the city to deny it. the governor has one less legal issue on his plate tonight. gay marriage. they wanted the supreme court to force the governor and the attorney general to challenge the ruling to declare prop 8 unconstitutional. this afternoon the supreme court refused to allow them to file on behalf of prop 8 supporters. last month a judge in san francisco struck down the proposition as a violation of constitutional rights. conservatives turned to the governor because of an appeal from prop 8 sponsors might not be length mat without the state's backing. well, still ahead here at 6:00 where everybody knows your

has set at least 15 fires since spring, many of them near brayly park and just into the news room tonight sunnyvale police released a new picture of the suspect in the case. people are warned to be on guard. george. >> that's right. a few public safety officers have been going door to door. they have been passing out the flyers. on the flyer the person of interest in the arson case. sunnyvale putting them under pressure to catch him. >> when she moved into her home july 4th weekend she had no idea a few days later she was in for a fiery surprise. >> when we came up here, it was smelling old like burnt et cetera, and that side of the car was burned ebadly. >> she said someone set her

trees on fire. this was one of 15 fires set by someone since may a. nine fires happened last wednesday. >> i don't know who -- who does this. i mean -- we're a bit afraid. >> there was a fire on an old san francisco road last wednesday. he had come home from work and was eating dinner and he heard a loud noise. >> i opened the door and seen a flame on a white pickup truck. >> police sent out flyers saying the arsonist has been targeting piles of dumpsters, cars, and trash and lighting them up. the public safety sent out another flyer, this one with a sketch of the person of interest. if you have any interest please call the police in sunnyvale. thank you, george. stabbed at susan yore. a vallejo student recovering

from a knife wound after another student attacked him. police say two of the boys, seniors, got into an argument when suddenly pulled out a knife. the 17-year-old victim was slashed several times around the face and neck. the suspect was arrested nearby walking. a tug boat leaking over 600 gallons of fuel is over tonight. the state department of fish & games says the leaking tugboat created a two-mile-long sheen on the river prompting the temporary ban on fishing. crews are cutting up the boat to get it removed. so far there are no signs any wild lyre has beenlife has been the spill. >> guess where jeff ranieri is tonight? he's tending to his crops. >> reporter: yes, we're tending to a lot of crops. i got a little lesson on what some of these things are out

as governor, he cut waste got rid of the mansion and the limo budgets were balanced. $4 billion in tax cuts. world class schools and universities. clean energy promoted. 1.9 million new jobs created. california was working. i'm jerry brown. california needs major changes. we have to live within our means; we have to return power and decision making to the local level-closer to the people and no new taxes without voter approval. jerry brown the knowledge and know-how to get california working again.

his way, the bay area will play host to the world's fair in the year 2020. governor schwarzenegger plans to visit the shanghai world expo in china during his travels this week. he pla he's taking business leaders from the bay area council with him. the world fair is held every five years. milan has already claimed the 2015 spot. after almost five months bp released the results of its internal investigation into the well. today, the controversial report outline as what the company

believes led to the deadly explosion and ultimately the worst oil spill in u.s. history. for more than 140 days bp has been spreading resources, dispersants, and some recovery funds to victims of the spill. but now it appears the company is spreading the blame on the deepwater horizon tragedy. >> there was no single action or ina that caused the accident. >> reporter: an internal investigation says eight key failures led to the explosion and skplaps of that well, most of those, according to the report, the responsibility of the rig's operator, transoceanht commented the well. six instead of the 21 recommended by halliburton and the decision to replace heavy drilling mud with water. the congressional leaders say

the cost-saving maneuvers led to the disaster. he calls the bp investigation a, quote, self-serving report that attempting to conceal the critical factor that set the stage for the mccondo incident. there was no immediate response from halliburton. the report acknowledges that bp personnel on the well accepted well integrity tests and failed to recognize increasing pressure and an influx of rising karbons in the riser until it was two late. the most important part of the investigation is still ongoing though. federal agents are examining the failed blowout preventer recently pulled from the floor of the gulf as the department looks into fines and possible criminal charges. >> it will be a while before that investigation is complete and a bit longer before the well is officially killed.

thad allen says they're altering the procedure and that won't begin till the middle to end of the month. here's something that might give parent as little confidence. child safety seats are getting better. 72 different seats were tested. 21 of them got a top rating of best bet. that's 12 more than last year. the studies suggest that the seats are being designed with more precision now. for parents the improved results mean that finding a seat will be easier and include a wider range of choices. skpirts do warn, however, how to use and adjust the safety seat is as important as the brand of seat you choose. >> boy, isn't that important. most install their car seats incorrectly. you can take it usually to a belie police station and they'll do it for you. shaken but not stirred. san francisco's bad boy reveals his plan once he leaves office and it's got a lot of people buzzing. they promise action this week over a controversial plan

well, here we go. in the time that it's taking me to introduce business and technical reporter scott budman you could have searched for a dozen things thanks to a google update. i wonder if my fingers are fast enough. >> they're getting faster. as quickly as you can search for something on the internet google says, hey, you can do it faster. they're rolling out google instant, away of predicting what you want to find. it's predictive search where for example "w" will bring you weather. it's also a potential boon for advertisers. we brought up the letter "t,"

and it brought up target. it can shave anywhere from two to five seconds off of every querrey. if you extrapolate that on all of your searches, you'll have a little time on your hand. with new technology threatening to make searching easier for us, google wants to stay ahead. google shares up today which led the overall market higher making up some of what it lost yesterday, investors jumping in to buy shares of apple, netflix, and ebay, but still sending hp embroiled in that lawsuit over mark hurd going to oracle lower. apple getting in the competition on the music side of things. buying online music retailer, amazon not saying what it will do with the site, but like appling, it's been letting you buy and download music. jessica, more competition means good news for consumers when it comes to choice and price. >> okay. thank you, scott.

>> you bed. fayette workers are keeping an eye on the california supreme court. the reason. they heard arguments over whether governor schwarzenegger has the authority to force them to take furlough days. we have the latest. >> reporter: no sooner had the lawyers started speaking before the supreme court today, then the justices started peppering them with questions. >> and how has he admitted that? >> reporter: the lawyer for governor schwarzenegger argues that the governor has the power to order workers to tay take unpaid days off. >> he has the inherent authority do what he did. >> reporter: union lawyers say that's not true. >> that's the per view of the legislator. >> reporter: many of the judge's questions focus on the fact that the law allows the governor lay off state workers so they asked

why not furloughs as well. some justices also pointed out the legislature has passed two budgets that take into account the savings from furloughs. >> what's your response from the argument that the legislature by doing what it did approved off the furlough? >> i'm hopeful that they'll end up on our side. it's hard to tell by the questions but they really focused on the critical issues. >> most of today's questionings came from three of them. legal experts say that likely indicates that one of them will end up writing the ruling, scheduled to come out sometime in the next three months. well, some strong and predictable criticism was directed at governor schwarzenegger today as he prepares to hand over seas despite the fact that the state has no budget. we have more on what's at stake.

've had to lay off a hundred people and to walk into a room and lay off is not easy. >> reporter: in the midst of this mess governor schwarzenegger is packing up and heading off to asia. >> governor schwarzenegger, postpone your trip to china. stay here and work with the legislature and a fair and balanced budget agreement. right now nothing is more important to the people of this state. >> reporter: but schwarzenegger says trade development is important too. that doesn't fly with joy. her center faces foreclosure at the end of the month. >> he needs to finish the job. finishing the job mediums coming to an agreement on the state budget. >> we're going in for hopefully another productive session. we all want to get this done.

making oakland the 4th most dangerous city in america. jerry brown. he just can't deliver the results california needs now. some medical news tonight. there's a new study out suggesting that high doses of vitamin b may delay the onset of alzheimer's. researchers say it greatly reduces brain shinkage by protecting the brain. it shrinks every year after the age of 60. experts are advising against taking higher than the wreck menned level of vitamin b until more research is conducted. well, snacking -- you probably already know this -- is more popular than ever before. over 50% of americans say they eat three or more snack as day compared to 7% who snacked in
